Supervisory proceedings are an exceptional stage in which the Presidium of the Supreme Court of the Russian Federation checks the legality of acts of lower arbitration courts that have entered into force in order to ensure the unity of judicial practice.

Appealed to the Presidium of the Supreme Court of the Russian Federation:

  1. Awards of the Judicial Collegium of the Supreme Court of the Russian Federation that have entered into legal force, adopted in the first instance, if these decisions and rulings were the subject of an appeal
  2. Rulings of the Board of Appeal of the Supreme Court of the Russian Federation, issued on the basis of the results of consideration of appeals, submissions against decisions or rulings of the Judicial Board of the Supreme Court of the Russian Federation, adopted in the first instance.
  3. Rulings of the Judicial Collegium of the Supreme Court of the Russian Federation issued in the course of cassation proceedings.

Judicial acts are subject to annulment or amendment if, when considering the case by way of supervision, the Presidium of the Supreme Court of the Russian Federation establishes that the contested judicial act violates:

  1. Human and civil rights and freedoms guaranteed by the Constitution of the Russian Federation, generally recognized principles and norms of international law, and international treaties of the Russian Federation.
  2. Rights and legitimate interests of an indefinite circle of persons or other public interests.
  3. Uniformity in the application and (or) interpretation of the rules of law by the courts.
