In addition to the provisions of Chapter 30 of the Civil Code of the Russian Federation, which governs the core mechanics of purchase and sale transactions, the Rules for the Remote Sale of Goods are also fully applicable. These Rules define the remote sale of goods as a transaction executed under a retail purchase and sale agreement concluded on the basis of the buyer's acquaintance with the description of the goods provided by the seller in catalogs, brochures, booklets, or via photographs, telecommunications networks—including the 'Internet' information and telecommunications network—television and/or radio broadcasting networks, or by any other means that preclude the possibility of the buyer directly inspecting the goods or a sample thereof at the time of entering into such an agreement.
A distinctive feature established by these regulations concerns the procedure for disclosing consumer product information. Specifically, at the time of delivery, the seller is legally obligated to provide the buyer with the following disclosures in writing: the designation of the technical regulation or other statutory markers established by the legislation of the Russian Federation on technical regulation evidencing mandatory conformity assessment; comprehensive details on the primary consumer properties of the goods (including explicit ingredient compositions for food products); the exact price in Russian Rubles and specified terms of purchase; warranty period details; rules and conditions for the efficient and safe utilization of the products; service life or expiration metrics; the exact location and corporate name of the manufacturer (seller), the address of the entity authorized by the manufacturer to accept consumer claims and perform technical maintenance, and for imported items, the country of origin; evidence of mandatory compliance with statutory safety standards protecting consumer life and health; and explicit information regarding the rules governing the execution of retail sales, among other regulatory disclosures.
Online Retailers: Legal Requirements for Sellers and Statutory Compliance
Furthermore, e-commerce vendors must satisfy the following critical regulatory requirements:
- Federal Law No. 152-FZ "On Personal Data" dated July 27, 2006. Since completing transactions on most e-commerce platforms requires consumers to enter information such as full names and payment details (e.g., credit card numbers), the vendor acts as a personal data operator. Consequently, the data operator is legally mandated to publish a comprehensive privacy policy directly on its website.
- Intellectual Property Regulations. It is critical to mitigate risks associated with the unauthorized use of online storefront names and digital assets, including images registered as trademarks. Online businesses should likewise refrain from duplicating photographic or textual content from third-party sites.
- Federal Law No. 38-FZ "On Advertising" dated March 13, 2006. Pursuant to Article 8 of this law, advertisements for distance sales must explicitly disclose the seller's corporate details, including corporate name, registered office address, and the Main State Registration Number (OGRN) for legal entities, or the full name and state registration number for individual entrepreneurs (OGRNIP).
