On February 2, 2018, participants and external attendees of the Pharmaceutical Law project at the HSE University Faculty of Law gathered for a lecture by Roman Shabrov, Partner at BRACE Law Firm.

Roman Shabrov delivered a presentation focusing on the public procurement of medicines. The lecturer elucidated the intricacies of the contract system, delineating the distinctions between Federal Law No. 44-FZ dated April 5, 2013, “On the Contract System in the Procurement of Goods, Works, and Services for State and Municipal Needs” and Federal Law No. 223-FZ dated July 18, 2011, “On the Procurement of Goods, Works, and Services by Certain Types of Legal Entities.” Furthermore, he provided a detailed overview of procurement lifecycle stages, the methodology for determining the initial maximum contract price (IMCP), and the specific regulatory requirements for describing pharmaceutical products as objects of state-owned and state-corporate procurement.

The session also enabled attendees to clearly distinguish between various procurement methods, including competitive tenders, auctions, requests for quotations, requests for proposals, and single-source procurement.

Departing from the traditional lecture format, the session offered an interactive case study, allowing all attendees to actively engage in practical analysis rather than remaining passive listeners.

The Pharmaceutical Law project team expresses its gratitude to Roman Shabrov for delivering an engaging session, as well as to all active participants who took part in the mock trial proceedings.
